INDEMNITY STATEMENT
TERMS & CONDITIONS
1) CONTRACT:
This contract is between the client and the
company Camp Xaragu cc.
2) DEFINITIONS:
Booking: A reservation which is done by the client
or the client's travel agency.
Client: (a) The person who accepts the booking, on behalf of himself, and persons under his authority if such booking is not done through a travel agency, which means that all are bound by the booking conditions as if they had individually made the applications themselves.
(b) The travel agency who places or accepts a booking for any person or group of persons or company with Camp Xaragu cc.
3) PAYMENT:
Payment in full 30 days prior to arrival. Bank transfer costs are paid by client. Unfortunately we do not accept any creditcards, because bank costs are extremely high and rediculous for both sides. Please send proof of payment by fax or email. We will acknowledge payment.
4) CANCELLATIONS:
Cancellations must be made in writing. Upon receipt of the written notification the following charges apply:
Up to 14 days: 20%
14 – 7 days: 50%
7 – 0 days: 100%
Please note, that if the reason for cancellation falls within the terms of any holiday insurance clients hold, then any such charges would normally be refunded to the clients by the insurance company, subject to the terms of the insurance.
5) PRICE:
Prices can be changed without prior notice, depending on government increases like in National Parks and Value added Tax (VAT). All prices mentioned include 15% VAT.
6) AUTHORITY IN THE CAMP:
At all times, the decision of the camp manager will be final on all matters likely to endanger the safety and well being of the passengers. The clients must at all times strictly comply with laws, customs and foreign exchange regulations of all the countries visited. Should the client be detected in any contravention of the law, customs or foreign exchange regulations, or should the client be a nuisance, the camp manager may order the client to leave the camp without the right to refund.
7) ACCIDENTS:
while every precaution is taken to ensure the safety of all persons participating in the camp, the client, his/her heirs, dependants, agents, executors or their assignees, hereby irrevocably waive any rights which they may have to claim any form of compensation for any damages which they may suffer due to injury or death during, or at any time after the stay, from Camp Xaragu cc. Under no circumstances will Camp Xaragu cc. be responsible for death or any injury or loss which might occur to such persons sustained from any cause whatsoever. The client hereby indemnifies and holds Camp Xaragu and its Directors and Staff harmless against any and all claims of whatever nature.
8) HEALTH:
It is the client's responsibility to ensure that he/she is medically fit and able to embark during the stay. Anti-Malaria precautions should be commenced prior to departure and clients should bring insect repellent.
9) PHOTOGRAPHY:
Camp Xaragu cc. reserves the right without giving further notice, to make use of any photographs or film produced by the company during any of their stay for general publicity purpose without payment or permission.
10) INSURANCE:
It is a condition of travel with Camp Xaragu cc. that all guests must have insurance for medical expenses, baggage loss, cancellation/curtailment, default and personal accident.
11) LIABILITY/RESPONSIBILITY:
The client should get him/herself acquainted with customary practices. Camp Xaragu cc as well as co-operating agents do act only in the capacity of agents for the clients in all matters and and will under no circumstances whatsoever be responsible and be exempt from any liability for accidents, injury, delay, loss or damage to property or any other loss or damage from whatever it may arise.
This brochure is correct at the time of printing. Camp Xaragu cc. cannot be held responsible for any changes or inaccuracies which may occur after printing. Only the English version of these terms and conditions is valid.
